The Federal Government’s allegations that suspended Central Bank of Nigeria (CBN) Governor Godwin Emefiele had illegally possessed firearms were dismissed by the Federal High Court in Lagos.
Following Mohammed Abubakar, the Director of Public Prosecutions (DPP) in the Ministry of Justice, motion to withdraw the two-count charge, Justice Nicholas Oweibo issued the ruling on Thursday.
Abubakar cited Section 108 of the 2015 Administration of Criminal Justice Act (ACJA) in support of his argument.
J.B. Daodu, Emefiele’s attorney, had claimed that the prosecution could not drop the charges unless the government first absolves itself of its disobedience to the court’s decision granting Emefiele N20 million bail on July 25.
According to The Nation, Justice Oweibo’s decision approved the Federal Government’s application.
The judge criticized the Government’s actions and stated: “The prosecution’s actions have demonstrated that it does not respect the rule of law.
When the prosecution has disrespected the court, what advantage would it serve to keep the file on the docket?
In light of this, the charge is accordingly dismissed for lack of active pursuit.
