Abba Kyari, the Deputy Commissioner of Police who was suspended, filed an appeal with the Court of Appeal in Abuja, but it was denied.
The appeal sought to overturn a previous Abuja Federal High Court ruling that denied his request for bail.
Justice Stephen Adah read the unanimous decision of a three-man panel, arguing that Kyari’s appeal was without merit. He also said that because of the nature of the charges that are pending against Kyari and others in the trial court, requests for bail should be handled with caution.
He concluded that Justice Emeka Nwite of the Federal High Court in Abuja, who had previously denied Kyari bail, exercised his discretion appropriately when denying Kyari bail.
The National Drug Law Enforcement Agency is considering prosecuting Kyari, a former head of the Nigeria Police Force’s Intelligence Response Team (IRT).
A Federal High Court in Abuja indicted him along with four members of the IRT—ACP Sunday J. Ubua, ASP Bawa James, Inspector Simon Agirgba, and Inspector John Nuhu—on charges of conspiracy to deal in 17.55 kilograms of cocaine.
They were also accused of dealing cocaine without permission; unlawfully tampering with the 21.35 kilograms of cocaine seized from two convicted drug dealers and conspiring to tamper with cocaine.
