Posted by A warrant of arrest issued by a Rivers State High Court in a criminal case filed by the Rivers State Government against Rotimi Amaechi, a former governor of the state, and five other defendants has been overturned by a Port Harcourt Court of Appeal.
Amaechi, Patrick Tonye-Cole, the All Progressives Congress’ (APC) candidate for governor of Rivers State in the recently concluded 2023 election, Augustine Wokocha, a former commissioner for energy, and three others were the subjects of an arrest warrant issued by Justice Chiwendu Nwogu on May 17, 2023. The warrant was contested in the Appeal Court.
In a unanimous decision on the application, a three-person panel chaired by Justice Joseph Ikyegh ruled that the Rivers State High Court erred in continuing with the case when the procedure had previously been contested before the Appellate Court.
According to xandertech, the three-person panel of the Appeal Court invalidated the warrant of arrest order issued against Amaechi and five other people and criticized the method of serving the defendants.
The decision of the Appeal Court in the case, according to one of the attorneys for Amaechi and the other defendants, Achinike Williams, “has put a stop to the illegality of the Rivers State Government under former Governor Nyesom Wike.”
